The sale contract used by the Dubai Land Department between seller and buyer is known as Form F, or Contract F, or the MOU. Form A (seller and broker), Form B (buyer and broker) and Form F were all launched in 2014. Currently brokers produce Form F using the Dubai Brokers app. Once created it must be approved by both seller and buyer.
A Form F includes details such as: seller, buyer, property, purchase price, payment plan, transfer date, tenancy, brokers and the fees payable by each party. Additional conditions may be included provided they do not override the existing conditions in the contract. If obtaining a mortgage for the property a condition allowing protection of the deposit in the case of the mortgage lender rejecting the application should be requested.
Typically a 10% deposit is paid at contract and is held by the broker or trustee in the form of manager's cheques until transfer. However within each Form F the timeframes and size of the deposit can vary. In the case of a breach of a condition in a Form F a settlement meeting is arranged by RERA prior to the dispute reaching the courts.
